These Terms and Conditions (“Terms”) apply to the use of ProDVX devices running Android Open Source Project (AOSP) software. By using a ProDVX Android AOSP device, you agree to these Terms. If you do not agree, please refrain from using the device and its software.
ProDVX devices are designed for professional and commercial applications. Unless explicitly stated otherwise, ProDVX devices do not include Google Mobile Services (GMS), Google Play Store, or any other proprietary Google applications.
2.1. ProDVX Android AOSP software is based on the Android Open Source Project and may include additional proprietary software developed or licensed by ProDVX.
2.2. The software provided on ProDVX devices is licensed, not sold. ProDVX and its licensors retain all ownership and intellectual property rights to the software and firmware.
2.3. Users may not reverse engineer, decompile, disassemble, modify, or redistribute the software unless expressly permitted by applicable law or by written consent from ProDVX.
3.1. ProDVX may release updates, patches, or security improvements for AOSP devices from time to time.
3.2. Updates may include enhancements, bug fixes, and feature improvements. ProDVX is not obligated to provide updates for any specific duration unless contractually agreed.
3.3. Installing unauthorized software or modifying system components may void your warranty and could affect device functionality or security.
4.1. As non-GMS devices, ProDVX Android AOSP devices do not include (by default) Google Play Store, Google Play Services, Gmail, YouTube, or any other Google applications.
4.2. Users may install third-party applications compatible with AOSP at their own discretion and responsibility.
4.3. ProDVX is not responsible for the functionality, security, or data handling practices of any third-party applications or services.
5.1. Warranty coverage for ProDVX devices is defined in the official ProDVX Warranty Policy available at www.prodvx.com.
5.2. Software support is limited to the officially provided AOSP firmware releases and updates.
5.3. Modifications, rooting, or installation of non-ProDVX firmware may void the warranty and invalidate technical support eligibility.
6.1. ProDVX devices may collect limited technical data necessary for product functionality, diagnostics, and updates. This may include system logs, crash reports, and device identifiers.
6.2. ProDVX fully respects and complies with all applicable GDPR (General Data Protection Regulation) requirements. Any collected data is processed securely, used solely for legitimate operational purposes, and never shared with third parties without explicit consent, except as required by law.
6.3. Users are responsible for ensuring their own applications, configurations, and integrations comply with relevant data protection laws.
7.1. To the fullest extent permitted by law, ProDVX shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of or inability to use the device or software.
7.2. ProDVX’s total liability shall not exceed the purchase price of the device in question.
8.1. These Terms remain in effect as long as the device or software is used.
8.2. ProDVX may terminate software licenses or access to services if a user violates these Terms.
ProDVX reserves the right to modify or update these Terms at any time. Updates will be published on the ProDVX website. Continued use of the device after such changes constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in ’s-Hertogenbosch, The Netherlands.
